Rockhouse Agency LLC – Terms & Conditions
1. Copyright Protection
1.1 All photographs and videos produced by Rockhouse Agency LLC are protected by copyright laws. Rockhouse Agency LLC retains full copyright and ownership of all images and video content.
1.2 Only one version of the services booked will be delivered unless additional versions or revisions are requested in writing and paid for.
1.3 Unauthorized reproduction, distribution, or use of the media without Rockhouse Agency LLC’s explicit written consent is strictly prohibited.
1.4 Clients are granted a limited, non-exclusive, non-transferable Commercial Use License to use the media solely for business and marketing purposes, including property listings, social media, advertising, and promotional materials. This license is valid for the duration of the active listing. If the listing expires or is canceled, and the client renews the listing agreement, the license must also be renewed for a fee of 50% of the original service cost.
1.5 Media licensing is granted only to the paying client. Any other party wishing to use the media must purchase a separate license.
1.6 Resale or transfer of the license is strictly prohibited. Any use of the media beyond the licensed scope without written consent constitutes copyright infringement.
1.7 Marketing & Portfolio Rights
Rockhouse Agency LLC retains the right to use any photos, videos, or other media created under this agreement for marketing, portfolio, and promotional purposes, including but not limited to use on social media, websites, advertising, and other digital or print platforms.
2. Branding & Watermarking
2.1 Rockhouse Agency LLC reserves the right to include a discreet watermark or logo on delivered media.
2.2 The client may not remove, alter, or crop out the watermark without written permission.
2.3 When sharing media online, the client must credit Rockhouse Agency LLC by tagging or mentioning the business name or social media handles.
3. Scope of Services & Deliverables
3.1 Real Estate Photography/Videography is designed for property listings and MLS use. Standard package includes up to 30 MLS-ready images (covering main areas of the home in a clean, market-focused style). Minimal editing/retouching is included.
3.2 Interior/Detail Photography/Videography is a separate service designed for designers, builders, remodelers, stagers, or branding/editorial purposes. It includes more detailed/stylized shots, close-ups, vignettes, and advanced editing. Interior/Detail sessions are custom-quoted and licensed separately.
3.3 Videography follows the same rules as photography.
3.4 Deliverables are defined by the package booked. Additional images, alternate versions, or expanded deliverables will be billed at current rates.
4. Preparation Requirements
4.1 All properties must be fully prepared and photo-ready at the scheduled start time.
4.2 Rockhouse Agency LLC does not perform cleaning, decluttering, staging, rearranging, or script writing on-site.
4.3 If the property is not ready, it will be photographed as-is. If a delay is requested, the On-Site Delay Fee will apply of $25. If you request that I wait longer than 15 minutes, an on-site delay fee of $50 per 15 minutes (billed in 15-minute increments) will be applied.
4.4 If my schedule does not allow for waiting, I will photograph the property as-is or, if necessary, reschedule — subject to the Second Trip Fee stated in section 10 of the terms and conditions.

5. Script Assistance & On-Camera Coaching for Video
5.1 Included: Light assistance such as quick coaching for delivery, small last-minute edits to phrasing, and feedback on clarity and flow.
5.2 Not included: Full script development, rewrites, or creating scripts during the session.
5.3 If the agent is not prepared at the scheduled time, or if full script development is required, and/or additional time is needed, extra service fees will apply.
6. Post-Shoot Change Requests & Client “Misunderstandings, Mix-Ups, Difference in Expectations”
6.1 All services are provided according to the booking details and scope confirmed at the time of scheduling.
6.2 If the client requests changes after work has been completed — including but not limited to reshoots, additional images, or alternate versions — these will be treated as new work and billed at current rates, regardless of the reason given (including claims of “mix-ups” or verbal agreements not documented in writing).
6.3 The original work delivered remains billable in full and will not be discounted or replaced without payment for the new work.
7. Online Booking Policy & Calendar Hold Requests
7.1 All bookings must be made through the online booking system. Bookings are not accepted via phone or text.
7.2 Definition. A “Calendar Hold” is when a client requests Rockhouse Agency LLC to reserve a date/time while awaiting seller or third-party confirmation.
7.3 Hold Period. Calendar holds may be granted for up to 1 hour without charge. After 1 hour, the time will be released unless the session is formally booked through the online booking system.
7.4 Extended Holds. If a client wishes Rockhouse Agency LLC to block a slot for more than 1 hour without a confirmed booking, a Calendar Hold Fee of $50 per day will apply. This fee ensures the time is reserved exclusively for the client and prevents other bookings from being accepted.
7.5 Non-Refundable. Calendar Hold Fees are non-refundable. If the client later confirms the booking, the fee may be applied as a credit toward the session invoice at Rockhouse Agency LLC’s discretion.
7.6 No Guarantee Without Payment. Dates/times are not guaranteed unless either (a) the booking is confirmed through the online system, or (b) a Calendar Hold Fee has been paid or (c) payment has been made.
8. Payment Policy
8.1 Accepted payment methods:

Zelle (preferred): No additional fees.
Square (credit/debit): 3% processing fee added.
8.2 To avoid processing fees, clients are encouraged to pay via Zelle.
8.3 Late Payment Policy
Payment is due upon receipt of invoice. Any invoice not paid within 5 business days of the issue date will incur a $25 late fee.
8.4 In addition, invoices more than 30 days past due will accrue a late charge of 5% of the outstanding balance per month until paid in full.
8.5 Unpaid balances may result in suspension of services, withholding of delivered media, and/or legal collection proceedings.
9. Travel Fees
9.1 Locations within a 50-mile radius of Bakersfield, CA are subject to a $50 travel fee for select locations (please inquire).
9.2 Locations beyond a 50-mile radius of Bakersfield, CA are billed at the IRS standard mileage rate plus a flat travel fee starting at $100, which includes up to 2.5 hours of total travel time. Additional travel time may be billed at $50 per hour. Final travel cost may vary based on distance and time.
10. Second Trip Fee
10.1 If a second trip is required due to client-related issues (e.g., property not ready, access problems, or changes requested after completion), a $100 fee will apply.
11. Cancellation Policy
11.1 Standard Shoots (Local) – Cancellations or rescheduling must be requested at least 24 hours before the scheduled appointment. Requests made within 24 hours of the scheduled time will incur a $100 rescheduling or cancellation fee.
11.2 Out-of-Town / Travel Shoots – For shoots requiring travel outside the local service area, cancellations or rescheduling must be requested at least 48 hours in advance. Requests made within 48 hours will incur a $150 rescheduling fee, due prior to rebooking. This reflects travel time, blocked calendar availability, and turned-down bookings.
11.3 Same-Day or Last-Minute Cancellations – Cancellations or rescheduling requests made within 2 hours of the scheduled appointment may be subject to a full session fee, at Rockhouse Agency LLC’s discretion.
11.4 Reschedule Limits – Each booking includes one complimentary reschedule. Additional reschedules may incur a rescheduling fee, regardless of notice period.
11.5 Agency-Initiated Changes – Rockhouse Agency LLC reserves the right to reschedule or cancel due to inclement weather, illness, equipment failure, or other unforeseen circumstances. Clients will be notified promptly and a new session arranged at no additional cost.
12. Refund Policy
12.1 No refunds are provided for cancellations/reschedules within 2 hours of the scheduled session.
12.2 Refunds will only be considered if Rockhouse Agency LLC fails to deliver agreed services due to circumstances within our control. Quality concerns are evaluated at the sole discretion of Rockhouse Agency LLC.
13. Confidentiality & Privacy
13.1 Rockhouse Agency LLC respects client confidentiality. Personal or sensitive information is used solely to provide services.
13.2 Rockhouse Agency LLC may use select images for portfolio, website, social media, or other marketing purposes.
14. Governing Law
14.1 These Terms are governed by the laws of California.
14.2 Any disputes will be subject to the exclusive jurisdiction of the courts located in California.
By engaging in a photography session with Rockhouse Agency, the client acknowledges that they have read, understood, and agreed to abide by the terms and conditions outlined in this policy.
