Copyright Protection:

1.1 All photographs taken by Rockhouse Agency, hereafter referred to as "the Photographer," are protected by copyright laws. The Photographer retains the copyright and ownership of all images produced. Only one version of the services booked will be delivered. There are no revisions or second versions given unless requested in writing and paid for.

1.2 Unauthorized reproduction, distribution, or use of the photographs without the Photographer's explicit written consent is strictly prohibited.

1.3 Clients are granted a limited, non-exclusive license to use the photographs for personal or business purposes as agreed upon in the contract or invoice. This license is subject to the terms and conditions outlined herein and is valid throughout the duration of the listing. Should the listing expire or be canceled, and the client chooses to renew the listing agreement, they will also need to renew the license to use the photographs. The license's renewal fee will be 50% of the initial cost of the photography service as outlined in the original agreement.

1.4 The license granted to the client is non-transferable. This means that the client may not transfer or assign the license to any other party, either in whole or in part.

1.5 The client is expressly prohibited from reselling the license to use the photographs. Any resale or attempt to resell the license, or the photographs themselves, is a violation of this agreement and will be subject to legal action.

1.6 The rights provided to the client under the license are solely for the client's use as stipulated in the contract or invoice. Any use of the photographs beyond the scope of the license granted herein, without prior written consent from the Photographer, is not permitted and constitutes an infringement of copyright.

  1. Branding and Watermarking: 2.1 The Photographer reserves the right to include a discreet watermark or logo on all photographs delivered to the client. 2.2 The client agrees not to remove, alter, or crop the watermark or logo without the Photographer's written permission. 2.3 When sharing photographs on social media or online platforms, the client must credit the Photographer by mentioning or tagging their business name or social media handles.

  2. Online Booking Only: All bookings for photography sessions must be made through our online booking system. We do not accept bookings over the phone or through text messages.

  3. Cancellation Policy: 3.1 Cancellation or rescheduling of a photography session must be requested by the client at least 2 hours before the scheduled appointment time. 3.2 In case of a cancellation or rescheduling made within 2 hours of the scheduled appointment time, the client will be charged a cancellation fee of $100. 3.3 The Photographer reserves the right to cancel or reschedule a photography session due to unforeseen circumstances such as inclement weather, equipment failure, or illness. In such cases, the Photographer will make reasonable efforts to notify the client as soon as possible and arrange an alternative date and time.

  4. Refund Policy: 4.1 In the event of a violation of the cancellation policy (cancellation or rescheduling made within 2 hours of the scheduled appointment time), no refund will be provided to the client. 4.2 Refunds will only be considered if the Photographer fails to deliver the agreed-upon services due to circumstances beyond their control. The determination of unacceptable quality will be at the sole discretion of the Photographer.

  5. Confidentiality and Privacy: 5.1 The Photographer respects the confidentiality and privacy of their clients. Any personal or sensitive information shared during the photography session or through subsequent communication will be kept confidential and used solely for the purpose of providing services. 5.2 The Photographer may request the client's permission to use select images for promotional purposes, including but not limited to their portfolio, website, social media, or other marketing materials. The client has the right to decline such requests, and their decision will be respected.

  6. Governing Law and Jurisdiction: 6.1 This policy shall be governed by and construed in accordance with the laws of California. 6.2 Any disputes arising from or in connection with this policy shall be subject to the exclusive jurisdiction of the courts located in California.

  7. Travel Fees:

    1. $50 for locations within 50 miles of Bakersfield in Kern County. This applies to select locations only; please inquire about eligibility.

    2. For travel over 50 miles, my rate starts at $100. This includes the current IRS mileage rate plus a fee for my time. The final cost may vary based on distance and time required.

    3. 2nd Trip Fee:

      Should a second trip to the same location be required due to reasons not attributed to the Photographer (e.g., client request, insufficient preparation, or change of scene), a second trip fee of $50 will be charged.

By engaging in a photography session with Rockhouse Agency, the client acknowledges that they have read, understood, and agreed to abide by the terms and conditions outlined in this policy.
